the definition of “loitering” is to
“Stand or wait around idly or without apparent purpose.” We have a purpose with the signs to prove that purpose, just because the bankers don’t recognize that purpose and call the police does not make it any less a purpose.
The 1st amendment trumps city ordinances. ‘loitering’ is defined as hanging around for no apparent purpose- protesting is a purpose enshrined by the 1st amendment as the most sacred of rights ‘political speech’. ‘disturbing the peace’ has been used also been used by police to remove protesters and again and again cities have lost legal challenges in such cases. “First Amendment lawsuit filed against the city. As a result, U.S. District Court Judge L. Scott Coogler approved a consent agreement between the city and the group. Birmingham City Ordinance 04-99, which requires two or more people planning a demonstration to apply for a permit, pay a fee and get approval from the city will not be required. BigGuy I commend you on working to repair that damage done by those not supporting the peaceful protests of OWS. When I saw the reports, the video, I was sickened that they would damage all the good that is taking place. I wish I had the means to help out, may you be blessed by all you need to correct damage done by the others.
